22. The inflatable hire
season 2003 is well and truly underway now and many members have reported that
their takings are up on this time last year. BIHA membership levels have
increased dramatically in the last few weeks, and the total number of members as
at 30th June 2003 now stands at 631. This recent growth is largely down to
word of mouth recommendations from existing members and manufacturers. The
BIHA now represents nearly half of all the inflatable hire companies in the
UK. 2) PL Insurance
News. One subject has
dominated the BIHA and our industry during the spring and summer and this
has been the sharp increase in the cost of public liability
insurance. Although this is a setback for our businesses, it is
very important to put it into perspective, and realise that during the summer
season (April - Sept) our industry can be highly profitable .
There are many BIHA members who are earning £2,000 to £15,000+ per month
during the summer. PL insurance (although expensive) is a cost that must
be budgeted for. Many members have wisely put up their hire fees to
help absorb this extra cost. In geographical areas of intense
competition where some hire companies may operate without PL insurance
cover, then there must be additional value offered to the customer in order to
justify the extra hire charge. Examples of added value are a more
professional and friendlier telephone manner, a quality website, so that your
customers can see before they order. Cleaner inflatables, colour leaflets
and business cards, more flexibility in regards to the hire times, and
basically anything that you can do which makes you stand out from the
competition. Do remember that although price is important it is not the only
factor which determines whether a customer chooses you or your
competition. There are many
reasons for this sharp increase in the cost of PL insurance (which has affected
many industries). Some of the reasons cited are Sept 11th and also the
"no-win, no-fee solicitors" ("ambulance chasers") However, the tide may be
gradually turning in our favour. A few weeks ago, it was reported in the
national press that the "Accident Group" had gone into
liquidation. (The "Accident Group" were one of the largest and most
aggressive companies in the UK which specialised in pursuing claims for its
clients on a "no-win, no-fee" basis. Also, some other large "no win,no
fee" companies have hit major financial problems because comparatively few
cases are being won, and when a case is won the amount of compensation
paid to the claimant is often very low. Many of these companies
thought they could make a quick profit by providing a "no-win, no fee"
service, but are finding that it is not as profitable as they initially
thought. In many cases, these lawyers are spending many hours on a case ,
but when they get their fees they realise that they have been working for less
than the minimum wage! I know of one person who suffered whiplash injuries
as a result of a motor vehicle accident where he was a passenger in a bus. He
took the case to a "no-win, no-fee" solicitor, and after 5 years he was awarded
just £150 compensation and the solicitor received about £400 in legal fees.
£400 for 5 years ongoing work!!! no wonder that these companies are
running into cash-flow problems. As many of you will know, I have spent the last
few months contacting and visiting various insurance companies and brokers
throughout the UK in an attempt to get a fairer deal for BIHA
members. I am disappointed to report back to the membership that
my time and effort has yielded relatively little fruit.
However, one positive result is that I have located an insurance company
who is able to provide PL insurance for inflatables and other leisure equipment
(e.g. quad bikes) on a SUPERVISED BASIS ONLY at very competitive rates (and a
very low excess of £250). The broker who can be contacted for this type of
business is Gary Alexander of the Beech Tree Consultancy in Sussex. Gary's

for your supervised inflatables (and other leisure equipment) please list all
the equipment in your email which you would like to get
insured. The majority of
BIHA members operate their inflatables on a dry hire basis (i.e. unsupervised by
the owner). Currently (30-6-03), there is only one company that can write
PL insurance for inflatables on a dry hire basis. This is Leisureinsure

E own a bouncy castle which we hire out but we
cannot find an insurer, despite having had no claims for the past 10 years. Can

says: It seems you are not alone. The British Insurance Brokers' Association
(Biba) tells me there is something of a crisis in the bouncy castle insurance
market.
Only one company, Leisureinsure, is
offering cover for bouncy castles. It is not that hob-nailed boots have suddenly
become fashionable for children, says Leigh Kendall at Leisureinsure. He says
other companies previously in the market were not charging enough and were not
as strict about safety measures as they should have been, so they have faced a
lot of claims and have subsequently withdrawn from the market.
On one occasion a poorly-tethered
inflatable blew away into a caravan park, resulting in third party property and
personal injury claims.

(and by the sound of it there may be a few of you) can check out

year.
If it's any consolation, Biba is looking
into the situation.

One thing which the BIHA is aware of is that it needs to help
lower the risk of accidents occurring and hence claims possibly arising.
One way to achieve this is to ensure that all members abide by a code of
practice and minimum safety standards. In theory, this is the best
way. However, in practice, it is impossible to check and police
the way that a member operates, and ensure that they are meeting minimum
standards. If you doubt this, look at a motorway, everyone knows
that the legal speed limit is 70mph, but many vehicles travel well in excess of
it. Any vehicle travelling at over 100mph is a serious danger
to themselves and others. Similarly, insurance companies
know that a minority of inflatable hire companies will flout even the most basic
safety requirements and as a result accidents and claims may occur, but
unfortunately, even the most careful and safety conscious hire company is
penalised for the mistakes and incompetence of others. (very much like car
insurance).
I therefore propose that the
BIHA take a more pro-active approach in getting PL insurance premiums
lowered. We need to demonstrate to the insurance companies that we can run
safe businesses, where the risk of them having to pay out on a claim is very
low.
I believe that this can be
achieved in several different ways:
a) The launching
of a fighting fund (To pay a top solicitor to fight against a
claim).
b) The launching of an excess
insurance fund (To help pay a member's excess on a particular
claim).
c) Ensuring that each member
passes a short written examination (via email or post) to ensure they have an
understanding of minimum safety requirements for operating
inflatables.
d) Having a voluntary
"buddy" system, i.e. where two or more hirers team up together in a close
geographical area to check that they are meeting minimum safety standards,
and helping one another out if one hire company falls short of minimum
standards. An additional benefit of a "buddy" system, is that referrals can be
passed between them.
e) Ensuring
that the customer always reads (and signs) the disclaimer, terms and
conditions of hire, risk assessments and also safety instruction
sheet/safety cartoons etc.
3) BIHA Fighting Fund and an
excess fund.
As mentioned in the previous newsletter, the BIHA
intends to launch a fighting fund (run by Trustees) next month (July 2003) to
help any BIHA member fight any spurious, unfair or potentially
fraudulent claim made against them (particularly if a "no-win, no fee"
solicitor is involved). This fund will not be a substitute for PL
insurance (which all members should have - at least £1million), but may act
as a buffer between the member and the insurance company in the event of a
claim. Any money in this fund will be used to pay only the defence of any
court case and any associated costs. Any payment made will be at the
discretion of the trustees of the fighting fund, and may have to be made
with the permission of the member's PL insurance company.
One of the reasons why a fighting fund is deemed to
be important is because in the event of a spurious claim an insurance company
will often pay out compensation to the claimant because this is often cheaper
than hiring lawyers to fight a case. If a fighting fund was available then
this may reduce the likelihood of a "no-win, no-fee solicitor taking a BIHA
member to court over an unfair, spurious or potentially
fraudulent claim.
However, it must be emphasised that if an accident
occurs on an inflatable and it is directly the fault of the member (e.g. they
forgot to properly stake down the inflatable) - then it is unlikely that the
trustees of the fighting fund would agree to release money to pay legal
costs.
The main purpose of the fund would be to provide
funding for legal assistance if, in the opinion of the trustees, the claim being
made is unfair, spurious or potentially fraudulent.
Before this fund can be officially launched, the
BIHA would have to finalise the details with legal experts and also PL insurance

Secondly, one insurance broker has suggested to me
that PL insurance premiums may come down if there is a higher excess on
individual members policies (e.g. £10,000). Clearly, the downside of this
is that if a member had a claim against them, of say £9,000, then the insurance
company would not have to pay out anything, but a hire company could be
bankrupted. However, if the BIHA created a fund to help pay for this
excess then it could have the dual benefit of possibly bringing all our premiums
down and, at the same time, helping to ensure that if a member does have a
small(ish) claim then he or she is not forced into
bankruptcy.
These two funds would be managed by
trustees on behalf of members of the BIHA.
There are several ways of raising money for these
two funds: Here are some suggestions that have been put to me by various
members.
a) Ask manufacturers (and other related
companies in our industry) for sponsorship - in return for valuable
publicity for their businesses.
b) Organise a mini-lottery or prize draw each
month (e.g. each BIHA member contributing say £2 per month and the winner
gets say 25% of the month's takings. The remainder going into the Fighting
fund, and the excess fund.
c) Asking the Government for a
grant.
d) Organising fund raising
events.
e) Competitions within the BIHA.

I am open to all ideas about how to raise money for
these two funds.
With idea b) Organising a mini-lottery or prize
draw, I will have to fully check out the legalities behind it,
although in principle, I think that it is a good idea, and if enough
members committed themselves to it (for say only £2 per month by standing order)
then it could raise a significant sum of money very quickly, and one
member would win the jackpot (e.g. 25% of the fund ) each month. I
need to emphasise that although there is an element of enjoyment and
excitement to a BIHA lottery, at the end of the day the real purpose
is to raise money in order to indirectly try and reduce all our PL
insurance costs in the future, and help BIHA member(s) who may be facing a claim
against them, even though they may not necessarily be at
fault.
If you have any comments (positive or negative)
about the BIHA running a mini-lottery or prize draw amongst the members
to help finance a fighting fund and excess fund - please email them to me

to go to the vote. (I am aware that some
members may regard this idea as being unprofessional). However, the
national lottery is a proven tool in raising millions for good causes, and a
BIHA fighting fund / excess fund is definitely a good cause for the inflatable
hire industry.
4) Amusing comments, daft
questions and complaints from customers who have hired
inflatables. (I would like to thank all members who have contributed

inflated??" b) "Surely, if
the fan is kept on all the time the castle will eventually
explode!!" c) "I
would like to make a complaint......there is air gradually seeping out of the
castle, I think it is coming from the stitches on the
bed!!" d) After a very wet
day on the previous hire....a customer enquired as to whether the water which
was bubbling on the bed seams was at boiling
temperature!!?? e)
One customer asked "would you like some help setting up the bouncy castle" 5
minutes after all the equipment had been brought in to the back
garden!!. f) "Is it
OK if my pet Alsatian plays on the bouncy castle". g) After one member had set up the
inflatable, he was just leaving, when the customer rushed up to him and
said "you have forgotten the blower thing". She thought that once the
inflatable had been blown up, the blower could be removed, and the air pressure
would remain the same. h) One customer thought that the heavy duty safety mat was the
inflatable! and she expressed her disappointment in a very verbal
fashion!! When she realised she was wrong, she very quickly changed her
tune!! i) Here is a
conversation between a BIHA member and a customer on the subject of PL
Insurance. Gotta love some customers.Had a chap today tell me I'm not fully insured as my
PLI doesn't cover his negligence on a dry hire. Conversation went a bit like
this..... Customer: You fully insured?Me: We certainly are.Customer: So if a kid gets injured, your insurance would
cover it?Me: Well it does depend on the
circumstancesCustomer. What if a kid
climbs up one of the walls and falls out of the castle and hurts
themselves?Me: No my insurance does not
cover that. The child shouldn't be climbing up the walls if you are properly
supervising it.Customer: So you're
not fully insured?Me: I am
for what I'm liable for, but I'm not liable for actions out of my
control.Customer: So you're not fully
insured?Me: As I said, I'm insured for
what can be deemed my liabilities. If someone is injured as a result of my
equipment being faulty...or because of some action or inaction on my part, then
yes I am insured...but if there is a problem because of your
negligence, then no, my insurance does not cover that.Customer: So you're not fully insured?Me: It's immaterial, I couldn't rent a castle out to you in
any case.Customer: Why
not?Me: Cos you're too stupid

7) HINTS AND TIPS. a) If a customer rings you to
enquire about an inflatable, or just wants a quote, but they are not 100%
committed to booking it with you, then tell the customer that you will
provisionally book it for them - with no obligation whatsoever. Even if
they do not book it through you, at least you will have their contact details,
so they can be a prospect for the future. b) Hot tipA good way
to distribute leaflets at events when you are not around and this avoids asking
the host to give out your leaflets.Have a
look in office world or staples and see the range of plastic 'polyfile'
holders. these are robust clear plastic cases with an envelope style lid
which can be closed by a button. you can get a4, a5 or a6 or smaller
sizes.(they're only about 50p each)go into a
diy store and buy 2inch wide heavy duty velcro tape either in strips or a roll.
cut about 4inches in length and stick the more rigid 'hook' side on the back of
plastic case. the 'loop' side is best on the castle front as it is
more flexible (which helps when it comes to packing away). obviously, you
take it off when you deflate the castle.I think a6 (4 printed on one side of a4) is the best size - big
enough to catch attention and hold information but still quite
neat.it's a good idea to count the number of
leaflets you put in at the start e.g. 20, then you have an idea how many
have been taken! there are other leaflet
holders, but the envelope style lid and button closure on this one means this
one can stay on the castle during a shower and the leaflets keep
dry.it's also good to put it high (5ft is eye
level for adults) so adults can reach it, but not young
children! Thanks for this idea go to Katharine Campbell. c) Sometimes
when you deliver an inflatable to a garden, the garden is not level. If
you take a SPIRIT LEVEL with you you will be able to see where the gradient is,
and where it varies. This should help you position a slide or bouncer in
the safest position for the children. d) Using you diary
(preferable one A4 page to the day - available from WHSmiths or similar) when
you have delivered an inflatable - put a large tick next to the booking.
When you collect the inflatable simply cross the tick with a ballpoint
pen. You can then see instantly which inflatables have been delivered and
which ones have been collected. Simple but it works well. e) Bungee cords
(sometimes called elasticated luggage straps with hooks on) can be used to
keep smaller inflatables (up to say 15ft x 15ft) rolled up
securely. For larger inflatables it is better to use proper tie straps, as
they are more robust, and they can be tightened
easily. f) Check the oil level in your petrol blowers every time they
are used - if this is overlooked (which one member unfortunately did) and
it runs dry of oil, then the engine will overheat and seize - fit only for the
scrap heap. There should be a dipstick on every petrol
blower. g) If a castle gets wet, try and put it out again as quickly as possible
so that it dries out. Some BIHA members attach so much importance to this
that they will deliver the wet inflatable early to a customer so that it can
fully dry off in time for the party. h) Add a childrens inflatable
slide to the end of your obstacle course. Makes it a lot more fun and you
can charge the customer extra as well. i) When using petrol blowers on
a dry hire (i.e. unsupervised) - it is vital that you inform the customer
/ user that if they allow the petrol to run out, the blower will stop running,
and the inflatable will collapse. Remind the customer that after about 3
hours use they should switch off the blower and top it up with petrol if
required. On a supervised hire, it is important that the trained
supervisors regularly check the level of fuel. j) During the busy summer season
(May to September) you will find that your phone rings regularly with
enquiries especially if you have an advert in the Yellow Pages. Many
customers will not leave a message if they get through to an ansa-phone.
so to avoid missing vital bookings you have the choice of either call divert to
a mobile or alternatively have a secretary (or spouse) handling the phone
calls. If you have to leave your office unattended, the best time to do
this is between 14-30 and 15-30. The reason for this is because many mums
pick their children up from school at this time, so are less likely to call
you to book an inflatable. k) To help prevent the
theft of your van and the inflatables inside - use a high quality steering
lock. Many would be-thieves lose interest when they see a strong
steering lock and move on to another vehicle. I would like to say a

INFLATABLE To do a successful repair
to your castle you must use a PVC contact adhesive which most inflatable
manufacturers have in stock and also patches of PVC which is the same as what
your inflatables are made of.The patches
you should be able to get free of charge from a castle manufacturer because they
would only come off their waste pile but the adhesive you will have to pay
for.If you don't live near an inflatable
manufacturer to obtain the adhesive you might be able to get it from a
manufacturer and repairer of marquees because they use the same

I have a question as a still rather new hirer, I
have been checking over & cleaning my castles today after a busy weekend. To
find three patches of scribble in biro/ballpoint pen on a castle & I cant

All my goods and trailer were recently stolen from friends
lock up yard in Huddersfield West Yorkshire
These consisted of :-

4 * Red/Yellow Cub Karts approx 1.5 mtr in length and battery
operated.

8 * Batteries (These were flat and would require

Wonder if you could post this on your web site for an
unfortunate ex trader who has lost it all. (As no insurance was running for the
business to cover theft at that time)
